I don’t understand where she is going with this order,” Brad Moss, a national security lawyer, told CNN on Monday. Part of the law under which Trump is charged criminalizes a person having unauthorized possession of records related to national defense. Still, the judge asked prosecutors and defense lawyers to write versions of their proposed jury instructions that consider the PRA by April 2. “Engage with the following competing scenarios and offer alternative draft text that assumes each scenario to be a correct formulation of the law to be issued to a jury,” Cannon wrote on Monday. The second scenario would assume that as president, Trump had complete authority to take records he wanted from the White House under the PRA.

Judge Aileen Cannon, who is overseeing the case, has set apart an entire day to hear arguments on whether the prosecution should be thrown out on the basis of Trump’s claims about his presidential classification powers. Trump is facing dozens of charges related to his alleged mishandling of classified documents, and for obstructing the Justice Department’s investigation. As president, defense attorneys argue, Trump was the chief classification officer and could mark any documents as “personal” and legally take those documents with him when he left office. Their arguments cite the Presidential Records Act, the federal law that governs how documents from an outgoing presidential administration are handled. The PRA says the moment a president leaves office, the National Archives and Records Administration gets custody and control of all presidential records from their administration.

Before the judge were two of the nine motions to dismiss that the defendants have filed in the case. “It’s difficult to see how this gets you to the dismissal of an indictment,” the judge told Trump’s attorney Todd Blanche. Cannon said some of Trump’s concerns should be up to the juryThe judge repeatedly said Thursday that some of Trump’s arguments are best suited for a jury to decide during his eventual trial. Reagan’s journals were more akin to “personal records” as defined under the Presidential Records Act, they said. In Clinton’s case, the tapes were never reviewed and therefore never confirmed to contain classified information.

which found evidence Biden willfully retained classified materials but that the evidence did not rise to the level of proof beyond a reasonable doubt. And he took on criticism directly over his inclusion of the state of Biden’s memory. On the Republican side, lawmakers pressed Hur on why he didn’t charge Biden despite the evidence of classified documents in Biden’s possession. “In short, to borrow a phrase from the last administration, the Hur report represents the complete and total exoneration of President Biden,” Nadler said. Hur found some evidence that Biden willfully retained classified materials after he left the Obama White House.

In the 388-page report released last month, Hur concluded that Biden mishandled and improperly disclosed classified information after leaving the vice-presidency. But Hur said that he didn’t believe there was enough evidence to charge Biden with a crime. According to the transcript, Biden asks aloud when he was vice president, as he tried to recall timelines. “Remember, in this time frame, my son is either deployed or is dying,” Biden said, according to the transcript. The transcript shows investigators at times seeming to struggle to keep control, as Biden used up time with long answers.

CNN —Special counsel David Weiss ridiculed efforts by Hunter Biden, son of President Joe Biden, to dismiss tax charges against him as legally baseless and steeped in a “conspiracy theory,” in court filings Friday. The arguments between Weiss and Hunter Biden’s attorneys mirror arguments put forth by Donald Trump in his own special counsel cases. Their similarities underscore how cases brought by a special counsel – no matter who the defendant is – are often fought through similar, and sometimes political, playbooks. Like Trump, Hunter Biden has argued the special counsel overseeing his criminal cases was unlawfully appointed. Both Weiss and Smith pushed back in the same way, arguing that Garland has the authority to appoint whoever he wants as special counsel.

CNN —The Defense Department is analyzing a balloon discovered by fishermen off the coast of Alaska last week to determine whether it was a spy balloon, a spokesperson told CNN. Upon reviewing photographs taken by the fishermen, officials became concerned it could be another spy balloon, and FBI agents went to meet the boat when it returned to port. But the FBI determined that it was similar enough in appearance to a foreign government-owned surveillance balloon that it warranted further investigation. The existence of high-altitude surveillance balloons burst into US consciousness last year, when a Chinese spy balloon appeared to blow off course and transited across the continental US. The US assessed that the spy balloon was part of an extensive surveillance program run by the Chinese military, as CNN reported at the time.

CNN —A Google employee was charged Tuesday with stealing artificial intelligence trade secrets from the tech giant while secretly working with two Chinese-based companies in the AI industry. Linwei Ding, who also goes by Leon Ding, is charged with four counts of theft of trade secrets. As part of his responsibilities at Google, prosecutors say, Ding helped to develop the software deployed in Google’s supercomputing data centers. Ding was a junior employee, Google spokesperson José Castañeda told CNN, and the company monitors file transfers to cloud storage platforms including Google Drive and Dropbox. “We have strict safeguards to prevent the theft of our confidential commercial information and trade secrets,” Castañeda said.

CNN —The Massachusetts Air National Guardsman accused of posting a trove of highly classified intelligence reports and other documents on social media pleaded guilty on Monday to willfully retaining and disseminating national defense information. Jack Teixeira, 22, pleaded guilty to all six counts he faced under the espionage act during a hearing Monday morning. Teixeira stood between his two defense lawyers as he pleaded guilty Monday morning. According to court documents, Teixeira ran an obscure chat room on the social media platform Discord called “Thug Shaker Central,” where members posted memes and talked about guns and religion. Teixeira first began posting messages that included classified information in the Discord chat, according to prosecutors, and eventually posted photos of documents marked as classified.

CNN —Commercial fishermen off the coast of Alaska have found what officials are concerned could be another spy balloon and are bringing it to shore with them, three sources familiar with the matter told CNN. The existence of high-altitude surveillance balloons burst into US consciousness last year, when a Chinese spy balloon appeared to blow off course and transited across the continental US. The US assessed that the spy balloon was part of an extensive surveillance program run by the Chinese military, as CNN reported at the time. There were three additional shootdowns of unidentified high-altitude objects in the weeks following the Chinese balloon incident. NORAD later said in a statement that the balloon was “likely a hobby balloon” that posed no threat.

In Florida, meanwhile, a federal judge could push back Trump’s trial date in the classified documents case. Special Counsel Jack Smith and attorneys for Trump proposed moving the trial later into the summer in court filings Thursday. For Friday’s hearing in the documents case, scheduled for 10 a.m. Smith has highlighted a myriad of threats made against individuals connected to the documents case, including witnesses, government employees, an FBI agent involved in the initial Mar-a-Lago search and two federal judges, including Cannon herself. Attorneys for Trump and his allies are expected to argue that Wade and Willis lied under oath about when their relationship started.

CNN —Manuel Rocha, the former US ambassador to Bolivia accused of acting as a secret foreign agent of Cuba, said in court Thursday that he plans to plead guilty to charges, according to his court docket. During a hearing in Miami Thursday, Rocha and prosecutors “announce[d] the Defendant will be changing his plea,” according to the court docket. The court record does not give any information about what charges Rocha plans to plead guilty to. Rocha served as the US ambassador to Bolivia from 2000 to 2002 and as the deputy principal officer of the US Interests Section in Cuba in the 1990s. His role as the political officer at the US Embassy in the Dominican Republic gave him “special responsibility” for Cuba, prosecutors alleged.

Prosecutors and defense attorneys submitted a list of questions for potential jurors for the judge overseeing the case to review. The proposed jury questionnaire form gives insight into how each side in the case is approaching voir dire, or the process of questioning potential jurors, for the historic trial. The special counsel also opposes a question proposed by the defense seeking negative views potential jurors have of politicians. The documents case is one of four criminal prosecutions the former president and 2024 GOP frontrunner is facing. Meanwhile, the Georgia election interference case against Trump and several other defendants brought has been tied up by ethics allegations against District Attorney Fani Willis.

CNN —The Supreme Court agreed Wednesday to decide whether Donald Trump may claim immunity in special counsel Jack Smith’s election subversion case, adding another explosive appeal from the former president to its docket and further delaying his federal trial. The high court on Wednesday ordered that a lower court ruling against Trump remain on hold until it decides the issue. As is common when granting a case, the court released only a short order and did not indicate how the justices voted. Trump had filed an emergency request at the Supreme Court on February 12 asking the justices to block a lower court ruling that he was not immune from Smith’s election subversion charges. Trump and Smith filed dueling briefs at the Supreme Court over whether the decision should be put on hold.

CNN —A Georgia lawyer who had been billed as a star witness in the effort to disqualify Fulton County District Attorney Fani Willis did not deliver damaging testimony Tuesday on her romantic relationship with prosecutor Nathan Wade. “I do not have knowledge of it starting, or when it started,” Bradley said at one point. That filing leveled allegations that Willis and Wade engaged in an improper romantic relationship from which Willis financially benefited. “Why would you speculate when she was asking you a direct question about when the relationship started?” Sadow pushed. That means attorneys can use it to bolster their legal arguments about whether Willis should be disqualified without witness testimony.

“Meaning, ice her,” said a person familiar with Trump’s trial schedule strategy. That would create a hole in Trump’s court schedule after the New York trial that no other case is positioned to fill. The special counsel’s office has repeatedly argued that the public, too, deserves to have Trump’s federal election case before a jury quickly, potentially even before the next presidential election. While Trump couldn’t be on trial simultaneously in two different courts, judges could have overlapping schedules initially because trial dates can often move. He’s not going to be in more than one criminal trial at the same time.”CNN’s Hannah Rabinowitz and Holmes Lybrand contributed to this report.

His second arrest Thursday was on a new warrant for the exact same charges. In a brief order, district Judge Otis Wright, who will oversee the criminal case against Smirnov in California, raised the possibility that Smirnov’s defense lawyers might be trying to make it easier for him to flee the United States. Wright has scheduled a detention hearing for Smirnov in his Los Angeles courtroom for Monday morning. As a result, the public should have confidence that it will be conducted consistent with the rule of law,” Smirnov’s attorneys wrote. “In this case, the Court has prejudged the detention issue.”Smirnov’s attorneys declined to comment on Wright’s order.

CNN —Special counsel David Weiss asked a California judge Wednesday to send indicted ex-FBI informant Alexander Smirnov back to jail while he awaits trial. A magistrate judge in Las Vegas released Smirnov on Tuesday, finding that even enough Smirnov posed a flight risk, he could be released under certain conditions. Those conditions include GPS monitoring, confiscating his two passports, and ordering him to remain in Nevada where he currently lives. Smirnov is charged with lying to the FBI about the Biden family’s dealings in Ukraine. In the court filings, Weiss said that Smirnov repeatedly lied to his FBI handler, whom he worked with for more than a decade, and should not be trusted.

CNN —Hunter Biden’s lawyers accused special counsel David Weiss on Tuesday of using a since-discredited bribery allegation from an FBI informant to blow up his plea deal last year. House Republicans have championed Smirnov’s uncorroborated bribery claims against the Bidens and used his tips to fuel their impeachment inquiry into the president. Prosecutors were asked directly if the Justice Department could still bring charges against Hunter Biden under the Foreign Agents Registration Act despite the deal. Hunter Biden’s attorney, Christopher Clark, said he disagreed with the prosecutor’s assertion. Tuesday’s filing from Hunter Biden’s attorney also accused prosecutors of failing to abide by their obligation to turn over discovery in the Delaware case, including over allegations that Hunter Biden’s alleged gun bag had cocaine on it.

CNN —The former FBI informant charged with lying about the Bidens’ dealings in Ukraine told investigators after his arrest that Russian intelligence officials were involved in passing information to him about Hunter Biden, prosecutors said Tuesday in a new court filing, noting that the information was false. They said he previously told the FBI that he has longstanding and extensive contacts with Russian spies, including individuals he said were high-level intelligence officers or command Russian assassins abroad. The story, prosecutors noted, matches the story Smirnov told his handler about Hunter Biden being recorded in a foreign hotel. And, prosecutors wrote, Smirnov claims to have met with Russian intelligence officials as recently as November and December 2023. “He is actively peddling new lies that could impact U.S. elections after meeting with Russian intelligence officials in November.

CNN —Special counsel David Weiss charged a former FBI informant with lying about President Joe Biden and his son Hunter Biden’s involvement in business dealings with Ukrainian energy company Burisma Holdings. Alexander Smirnov, 43, is facing charges in connection with lying to the FBI and creating false records. CNN is working to determine whether Smirnov has an attorney. Smirnov’s charge undercuts a major aspect of Republicans’ claims that Joe Biden was financially benefiting from his son’s business dealings in Ukraine. According to court records, Smirnov told an FBI agent that he had spoken with the owner of Burisma about the company’s efforts to buy a company in the United States.

Washington CNN —Special counsel Robert Hur released a searing report Thursday that concluded President Joe Biden willfully retained and disclosed classified military and national security information but recommended he not face charges after a yearlong investigation into his handling of classified documents. According to the report, Biden – during the 2023 interview – did not remember when his son Beau died nor the years he was vice president. The special counsel report found that Biden willfully retained classified information, including top secret documents, and knew he was in possession of some documents as far back as 2017. House Oversight Committee Republicans, who have separately investigated Biden’s handling of classified documents, criticized Hur’s report before it was even released or delivered to Congress. “Most notably, after being given multiple chances to return classified documents and avoid prosecution, Mr. Trump allegedly did the opposite.” Hur wrote. “Among the places Mr. Biden’s lawyers found classified documents in the garage was a damaged, opened box containing numerous hanging folders, file folders, and binders,” the report said.
